1. Introduction
Welcome to Dynamotics.
These Terms of Service ("Terms") govern your access to and use of the Dynamotics platform, including our websites, software applications, dashboards, booking systems, and related services (collectively, the "Platform").
By creating an account, accessing the Platform, or using any services provided by Dynamotics, you agree to be legally bound by these Terms. If you do not agree with these Terms, you must not access or use the Platform.
Dynamotics provides online booking and appointment management software designed to help businesses manage appointments, customer interactions, staff schedules, services, and related business operations.
These Terms apply to businesses ("Merchants"), account administrators, staff members, and other users who access or use Dynamotics services.
2. Electronic Agreement
By creating an account, accessing the Platform, or using Dynamotics services, you acknowledge that you have read, understood, and agreed to these Terms.
Where permitted by applicable law, electronic acceptance of these Terms has the same legal effect as a written agreement.
3. About Dynamotics
Dynamotics is a software platform developed and operated from Sweden, providing digital appointment management and booking solutions for businesses worldwide.
The Platform allows businesses to:
- Create online booking pages
- Manage appointments and schedules
- Configure services and availability
- Manage staff accounts and permissions
- Communicate booking information to customers
- Use software tools designed to simplify appointment management
Dynamotics provides software infrastructure only. Businesses using Dynamotics remain responsible for their own operations, customers, services, and legal obligations.
4. Definitions
For the purposes of these Terms:
"Dynamotics", "we", "us", or "our" means the operator of the Dynamotics platform.
"Platform" means the Dynamotics websites, applications, dashboards, booking pages, and software services.
"Merchant" means a business or organisation using Dynamotics to manage bookings and appointments.
"Customer" means an individual who books an appointment with a Merchant through a Dynamotics-powered booking system.
"User" means any person accessing or using the Platform.
"Account" means a registered user account created to access Dynamotics services.
5. Eligibility and Account Requirements
To use Dynamotics, you must:
- Provide accurate and complete information during registration.
- Maintain the security of your account credentials.
- Use the Platform only for lawful purposes.
- Have authority to enter into these Terms on behalf of a business if creating a Merchant account.
You are responsible for all activity performed through your account. You must immediately notify Dynamotics if you suspect unauthorised access, security issues, or misuse of your account.
Dynamotics reserves the right to refuse account creation or restrict access where necessary to protect the Platform, users, or customers.
6. Merchant Responsibilities
Merchants using Dynamotics are responsible for:
- Providing accurate business information.
- Ensuring their services comply with applicable laws.
- Managing customer relationships.
- Providing appropriate privacy notices to their customers where required.
- Obtaining any required permissions or consents before collecting customer information.
- Ensuring booking information and business settings are accurate.
Dynamotics acts as a technology provider and does not control, approve, guarantee, or take responsibility for the services offered by Merchants.
A Merchant remains solely responsible for the appointments, services, prices, availability, and interactions they provide to customers.
7. Merchant Legal Compliance
Merchants are solely responsible for ensuring that their business operations, services, pricing, communications, and customer interactions comply with all applicable laws and regulations.
This includes responsibility for required licenses, permits, consumer rights, tax obligations, employment requirements, and industry-specific regulations.
Dynamotics provides software infrastructure only and does not provide legal, tax, accounting, or regulatory advice.
8. Customer Bookings
Dynamotics provides booking infrastructure that allows customers to schedule appointments with Merchants. When a customer submits a booking:
- The booking information is provided to the relevant Merchant.
- The Merchant is responsible for managing the appointment.
- The Merchant acts as the primary controller of customer booking information where applicable.
Dynamotics does not provide the underlying services booked through the Platform and is not responsible for the quality, availability, cancellation policies, refunds, or disputes related to Merchant services.
Any disagreement regarding a service, appointment, payment, cancellation, or refund must be resolved directly between the customer and the Merchant.
9. Booking Policies & Merchant Control
Dynamotics provides booking technology that allows Merchants to manage appointments with their customers. However, each Merchant remains responsible for establishing and enforcing their own booking policies.
This includes policies relating to cancellations, rescheduling, no-shows, deposits, payments, refunds, service availability, and customer communication.
Dynamotics does not determine, enforce, or guarantee the policies of any Merchant using the Platform. Customers should contact the relevant Merchant directly regarding appointments, payments, refunds, or disputes related to services.
Dynamotics is not a party to agreements between Customers and Merchants and is not responsible for services purchased, delivered, cancelled, or modified by Merchants.
10. Account Data & Ownership
Merchants retain ownership of the business information, service information, images, customer information, and other content they submit to Dynamotics ("Merchant Data").
Dynamotics does not claim ownership of Merchant Data. We only use such information as necessary to provide, maintain, secure, and improve the Platform.
Merchants are responsible for ensuring that they have the necessary rights and permissions to collect, store, and process customer information through the Platform.
Where available, Merchants may request access to or deletion of their account and associated data, subject to legal requirements and legitimate business needs.
11. Account Ownership & Access
The person creating a Merchant account is responsible for ensuring they have authority to create and manage the account on behalf of the business.
Merchants are responsible for managing user permissions and ensuring that employees, staff members, and other users only access information they are authorized to access.
Dynamotics may rely on instructions from authorized account administrators regarding account settings, changes, and account management requests.
12. Use of the Platform
You agree not to:
- Use the Platform for unlawful purposes.
- Attempt to gain unauthorised access to systems or accounts.
- Interfere with Platform security or functionality.
- Upload malicious code, viruses, or harmful content.
- Reverse engineer, copy, or modify the Platform.
- Use automated methods to scrape or extract Platform data without permission.
- Abuse, overload, or disrupt Dynamotics infrastructure.
Dynamotics may suspend or restrict access if we reasonably believe a user has violated these Terms.
13. Subscription Fees, Payments & Billing
Certain features of Dynamotics require a paid subscription. Subscription fees, available plans, and billing intervals will be displayed before you complete your purchase.
Dynamotics does not process payments between Merchants and their customers. Any payments, deposits, refunds, or financial arrangements between a Merchant and its customers are handled independently by the Merchant unless explicitly stated otherwise.
Payments for Dynamotics subscriptions are processed through third-party payment providers, including Stripe. By subscribing to a paid plan, you authorize Dynamotics and its payment providers to process payments according to your selected subscription plan.
Dynamotics does not directly store or process full payment card details. Payment information is handled by our payment processing partners, which maintain their own security measures, terms, and privacy policies.
Stripe may process personal and payment information in accordance with Stripe's own terms and privacy policies. By making payments through the Platform, you acknowledge that payment processing is subject to the applicable terms of the relevant payment provider.
Subscription plans are billed automatically on a recurring basis unless cancelled before the next billing period. You authorize recurring charges until your subscription is cancelled or terminated.
If a payment fails, Dynamotics may retry the payment or temporarily restrict access to paid features until payment is successfully completed.
Customers agree to contact Dynamotics directly regarding billing questions, payment errors, or refund requests before initiating a chargeback or payment dispute with their payment provider.
If a payment dispute, chargeback, or reversal is initiated, Dynamotics may provide relevant account, billing, and transaction information to payment providers, including Stripe, to investigate and respond to the dispute.
Fraudulent or abusive use of payment disputes may result in suspension or termination of the related account.
Subscription fees are generally non-refundable unless required by applicable law or otherwise stated by Dynamotics. Any refund requests must be submitted to Dynamotics and will be reviewed according to applicable circumstances.
Merchants are responsible for ensuring that billing information provided to Dynamotics is accurate and for paying all applicable fees associated with their account.
Prices may change from time to time. If pricing changes affect an active subscription, Dynamotics will provide reasonable notice before the new pricing applies.
Where required by law, applicable taxes, VAT, or other charges may apply and are the responsibility of the customer.
14. Free Trials and Promotional Offers
Dynamotics may occasionally offer free trials, discounted subscriptions, promotional pricing, or other special offers. The availability, duration, and conditions of such offers may vary.
Free trials and promotional offers may be subject to additional terms, eligibility requirements, usage limitations, or restrictions. Dynamotics reserves the right to modify, suspend, or end any trial or promotional offer at any time where permitted by applicable law.
Where a free trial requires payment information, you authorize Dynamotics and its payment providers to charge the applicable subscription fee when the trial period ends unless you cancel your subscription before the end of the trial period.
If you do not cancel before the trial period expires, your subscription may automatically convert into a paid subscription according to the plan selected during registration.
Trial periods and promotional discounts are intended for evaluation of the Platform and may not be combined with other offers unless explicitly stated by Dynamotics.
Unless otherwise required by applicable law, no refunds or credits will be provided for unused portions of free trials, promotional periods, or discounted subscription periods.
15. Subscription Cancellation
Customers may cancel their Dynamotics subscription at any time through available account management options or by contacting Dynamotics support.
Cancellation prevents future recurring charges but does not automatically provide refunds for previous billing periods unless required by applicable law.
After cancellation, access to paid features will continue until the end of the current paid billing period unless otherwise stated.
Dynamotics may cancel subscriptions where required by law, due to payment failure, misuse of the Platform, fraudulent activity, or violation of these Terms.
Upon account termination, certain account information may be deleted or anonymised after a reasonable retention period, except where retention is required for legal, security, or legitimate business purposes.
16. Intellectual Property
All rights, ownership, and intellectual property relating to Dynamotics, including software code, platform design, branding, logos, interfaces, documentation, and features, remain the property of Dynamotics or its licensors.
These Terms do not grant you ownership rights over the Platform. You receive a limited, non-exclusive, non-transferable right to use the Platform for its intended purpose.
17. User Content
Users may provide information, including business details, service information, images, logos, booking information, and customer-related information.
You retain ownership of content you submit. By uploading content, you grant Dynamotics permission to store, process, and display that content only as necessary to provide the Platform.
You are responsible for ensuring that your uploaded content:
- Does not violate applicable laws.
- Does not infringe third-party rights.
- Is accurate and appropriate.
18. Third-Party Services
Dynamotics relies on third-party providers to operate certain parts of the Platform, including hosting, database infrastructure, authentication, email delivery, security, analytics, and payment processing services such as Stripe.
Payment providers process transactions independently and may collect and process information required to complete payments, prevent fraud, and comply with financial regulations.
Third-party services operate under their own terms and privacy policies. Dynamotics is not responsible for failures, interruptions, or actions of third-party providers.
19. Availability and Service Changes
We aim to provide a reliable Platform but cannot guarantee uninterrupted availability. The Platform may occasionally experience maintenance periods, updates, technical issues, or temporary interruptions.
Dynamotics may modify, improve, replace, or discontinue features of the Platform when reasonably necessary. Where possible, significant changes will be communicated in advance.
20. Data Storage & Backups
Dynamotics takes reasonable measures to maintain the availability, integrity, and security of information stored through the Platform.
However, no online service can guarantee that data will never be lost, corrupted, or unavailable due to technical failures, maintenance, security incidents, or third-party service interruptions.
Merchants remain responsible for maintaining copies of important business information where necessary.
21. Communications
By using Dynamotics, you agree that we may send service-related communications including account notifications, booking-related messages, security alerts, and important updates regarding the Platform.
Marketing communications, where applicable, may include unsubscribe options in accordance with applicable laws.
22. Privacy and Data Protection
Your use of Dynamotics is also governed by our Privacy Policy, which explains what information we collect, how information is used, how information is protected, and your rights regarding personal data.
Where required under applicable data protection laws, Dynamotics may provide a Data Processing Agreement governing the processing of personal data on behalf of Merchants.
Merchants determine the purposes and means of processing customer personal data collected through their booking pages. Depending on applicable law, Merchants may act as data controllers and Dynamotics may act as a data processor when providing the Platform.
23. Security
Dynamotics implements reasonable technical and organisational measures designed to protect the Platform and user information. However, no online service can guarantee absolute security.
Users are responsible for maintaining secure passwords, protecting account access, and notifying Dynamotics of suspected security incidents.
24. Disclaimer of Warranties
The Platform is provided on an "as available" and "as is" basis. To the maximum extent permitted by applicable law, Dynamotics does not guarantee that:
- The Platform will always be available.
- The Platform will be error-free.
- Results obtained from using the Platform will meet specific expectations.
- The Platform will be suitable for every business purpose.
Dynamotics does not guarantee the actions, services, or reliability of Merchants using the Platform.
25. Limitation of Liability
To the maximum extent permitted by law, Dynamotics shall not be liable for:
- Loss of profits.
- Loss of business opportunities.
- Loss of data.
- Indirect or consequential damages.
- Disputes between Merchants and customers.
Nothing in these Terms limits liability where such limitation is prohibited by applicable law.
26. Indemnification
You agree to protect and indemnify Dynamotics from claims, damages, losses, or expenses arising from:
- Your misuse of the Platform.
- Your violation of these Terms.
- Your violation of applicable laws.
- Your content or services provided through the Platform.
27. Suspension and Termination
Dynamotics may suspend or terminate access if:
- You violate these Terms.
- Your use creates security risks.
- Your account is involved in fraudulent activity.
- Required by law.
You may stop using the Platform at any time. Termination does not remove obligations that arose before termination.
28. Changes to These Terms
Dynamotics may update these Terms from time to time. Updated Terms will be published on this page with a revised effective date.
Continued use of the Platform after changes become effective means you accept the updated Terms.
29. Governing Law and Disputes
These Terms are governed by and interpreted according to the laws of Sweden. Any dispute arising from these Terms shall be resolved by the competent courts of Sweden, unless mandatory consumer protection laws provide otherwise.
If you access Dynamotics from another country, you remain responsible for complying with applicable local laws. Nothing in these Terms removes rights that cannot legally be excluded.
30. International Users
Dynamotics is available worldwide. Users are responsible for ensuring that their use of the Platform complies with applicable laws and regulations in their own jurisdiction.
Dynamotics does not guarantee that the Platform is appropriate or available in every country.
